A Tesla Model Y owner is suing the automaker, alleging odometer manipulation that unfairly voided his warranty. Nyree Hinton, a financial analyst, purchased a used 2020 Model Y in December 2022 with approximately 36,772 miles, well within the 50,000-mile warranty.
After shipping the vehicle to Los Angeles in February 2023, Hinton experienced suspension issues requiring multiple service visits between March and June. Following these visits, he noticed a significant discrepancy in his odometer readings. His average daily commute mileage jumped from 55.54 miles to 72.35 miles, despite no change in the route.
By July, Hinton exceeded the 50,000-mile warranty limit. When a suspension recall was issued, Tesla refused to cover the repairs in January 2024, citing the expired warranty. This prompted Hinton to file a lawsuit, claiming breach of contract, negligent misrepresentation, and unjust enrichment.
The lawsuit alleges that Hinton’s Tesla recorded a 117% increase in mileage compared to his previous vehicles under similar conditions. He also claims the odometer underestimated mileage during a period with a longer commute.
In October, the suspension failed entirely, requiring a $10,000 repair. Hinton was then informed that Tesla repairs have a one-year warranty, suggesting the January repair could have been free.
Hinton is seeking damages and class-action status, citing numerous odometer complaints on Tesla forums. The lawsuit coincides with declining Tesla sales and controversies surrounding Elon Musk. We have reached out to Tesla for comment.
